By downloading or using the Harvest Collective LLC d/b/a ShinePay (“ShinePay”) mobile
application, you agree to abide by the terms and conditions set forth in these Terms of Service
(the “Terms”) — please make sure that you read them carefully before using the app. ShinePay
is not responsible for any uses of the ShinePay mobile application aside from those defined in
these Terms and make no representations or warranties regarding the effectiveness and fitness of
the mobile application for any other purpose than that expressed herein.
You agree that you will not copy or modify any part of the mobile application in whole or in
part, or any other intellectual property, trademark, patent, copyright, or other information or
design provided to you through the mobile application or ShinePay’s website in any way. You
agree that you will not attempt to extract the source code of this mobile application, and you
agree that you will not try to translate the mobile application into other languages or make
derivative versions in any form whatsoever. You further agree that you will not attempt to inject
any malicious code, worms, Trojan horses, bugs, or other code into the mobile application, nor
will you use the mobile application as a vector to send or inject malicious code of any kind to
any other service, server, website, or other platform. You agree to exclusively use the mobile
application for the purpose for which it was designed, and no others. The mobile application
itself, and all intellectual property, trademarks, copyright, patents, database access rights and any
other intellectual property rights related to it, belong exclusively and permanently to The
Harvest Collective LLC (or ShinePay).
Harvest Collective is committed to ensuring that the app is as useful and efficient as possible.
For that reason, Harvest Collective may make changes to the mobile application or to charge for
its services, at any time and for any reason. We will never charge you for the mobile application
or its services without making it very clear to you exactly what you’re paying for.
The ShinePay mobile application stores and processes personal data that you have provided to
http://getshinepay.com/privacy. In order to maintain the privacy of your stored data, it is your
responsibility to keep your phone secure and to maintain the use of strong password to restrict
access to its mobile applications. We further recommend that you do not jailbreak or root your
phone, which is the process of removing software restrictions and limitations imposed by the
official operating system and/or manufacturers of your device as doing so could make your
phone vulnerable to malware, viruses, or other malicious programs, compromise your phone’s
security features, or prevent the ShinePay mobile application from proper operation.
Additionally, data on your phone could be vulnerable without the protections placed upon it by
the device’s operating system and/or manufacturer.
Harvest Collective will not be liable for or responsible for proper operation of the mobile
application in areas where you do not have access to the internet, whether through Wi-Fi or
cellular access. Certain functions of the app will require the app to have an active internet
connection and can only be used or accessed when an active connection with the internet is
achieved. If you believe that your access to the internet is compromising your usage of the mobile
application, you should go to your cellular carrier and/or Wi-Fi ISP in order to determine
If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of
the agreement with your mobile network provider will still apply. You may be charged by your
mobile provider for the cost of data for the duration of the connection while accessing the app, or
for other applicable third party charges. In line with these prior obligations, you’ve already
accepted responsibility for any such charges, including roaming data charges if you use the app
outside of your home territory (i.e. region or country) as applicable. If you are not the bill payer
for the device on which you’re using the app, please be aware that we assume that you have
received permission from the bill payer for using the app. Harvest Collective shall not be liable
for any charges you incur for usage of the mobile application from your mobile provider, ISP, or
other internet provider, or any other third party with whom you incur charges in order to access
and/or use the mobile application.
Harvest Collective relies on third parties to provide information that we use to improve your
experience. However, Harvest Collective does not independently verify any information received
from third parties and therefore is not liable for any misrepresentations made by any third party
who provides information. If you believe that information Harvest Collective is receiving is
inaccurate, please contact us at firstname.lastname@example.org. Harvest Collective shall not be liable for any
loss, direct or indirect, in whole or in part, that you experience as a result of your reliance on the
functionality of the mobile application.
At some point, we may wish to update the mobile application. The mobile application is
currently available on Android and iOS – the requirements for both systems (and for any
additional systems we decide to extend the availability of the app to) may change, and the most
current version of the mobile application will be required to access and use the ShinePay service.
Harvest Collective does not promise that it will always update the app so that it is relevant to you
and/or works with the iOS/Android version that you have installed on your device. However,
continued operation of the mobile application will require the most current version. Harvest
Collective reserves the right to cease operation of the service and the mobile application, and
may terminate use of it at any time without giving notice of termination to you. Unless we tell
you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms
will end; (b) you must stop using the app, and (if needed) delete it from your device.
ShinePay is intended to make laundry easy with reduced fees. To achieve this, we are unable to
issue refunds for any and all reasons. All deposited funds must be used through the ShinePay
mobile application and are not otherwise useable or retrievable. We will attempt to fix any and
all payment errors we discover. If an error resulted in your receipt of fewer funds than you were
entitled, we will credit your ShinePay account the difference. If an error results in your receipt of
more funds than you were entitled, ShinePay will debit the extra funds from your ShinePay
account, your linked bank account if available, or we will request a return of the funds as a
condition of further usage of ShinePay’s app and/or services. Requests for refunds will be
evaluated on a case-by-case and Harvest Collective reserves the exclusive right to adjudicate
issues with payment from your account and deposits therein. If you believe that your deposit or
other action has taken place on your account and you suspect fraud or a mistake please notify us
within 72 hours of discovery.
ShinePay does not process payments made to your account. All payment processing is done by
third party vendors including Stripe, Inc. and any and all questions, concerns, and comments
with respect to payments made to your ShinePay account should be directed to Stripe, Inc.
ShinePay further does not control Stripe, Inc. and therefore you should familiarize yourself with
Stripe, Inc.’s terms of service before using their service to prepurchase washing machine and
clothes dryer usage with ShinePay.
Changes to these Terms
We may update these Terms from time to time. You are advised to review this page periodically
for any changes. We will post new Terms here. These changes are effective immediately after
they are posted on this page. Harvest Collective reserves the right to provide notice of any
substantive changes to these Terms, but it may elect not to do so. Therefore, if you choose to
continue using the mobile application, you are advised to occasionally review these terms to
determine if they have changed.
